This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "Customer") and Dependable Water Treatment ("we," "us," or "our") governing your access to and use of our customer portal, website, and related services (collectively, the "Service"). By creating an account, checking the box to agree to this Agreement, or otherwise using the Service, you agree to be bound by its terms. If you do not agree, do not create an account or use the Service.

1. The Service

The Service allows you to request service estimates, view and approve estimates and change orders, view and pay invoices, communicate with our staff, and manage your account information with Dependable Water Treatment. The Service is provided to support the home-service/handyman work we perform for you; it is not a general-purpose product independent of that relationship.

2. Account Registration and Security

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to gain unauthorized access to another customer's account, data, or invoices;
• Interfere with or disrupt the integrity or performance of the Service;
• Upload viruses, malicious code, or unlawful, defamatory, or infringing content; or
• Use automated means to scrape, probe, or access the Service outside of normal, individual use.

4. Estimates, Invoices, and Payments

Estimates you approve through the Service, and change orders you accept, authorize us to perform the described work at the stated price. Invoices are due according to the payment terms stated on the invoice. Payment card transactions are processed by our third-party payment processor (Stripe); we do not store your full card number. You are responsible for all charges incurred through your account.

5. Electronic Communications and Signatures

By using the Service, you consent to receive communications from us electronically, including by email and, if you provide a mobile number and choose to communicate by text, by SMS. You agree that an electronic signature you provide through the Service to approve an estimate or change order is a legally binding signature, with the same force and effect as a handwritten signature.

6. Intellectual Property

The Service, including its software, design, and content (excluding information you submit), is owned by Dependable Water Treatment or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purpose in connection with services performed for you. You may not copy, modify, reverse-engineer, or create derivative works of the Service.

7. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated this Agreement, or for any other business reason. Termination of your access to the Service does not affect any outstanding payment obligations for work already performed.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THIS SECTION DOES NOT AFFECT ANY SEPARATE WARRANTY WE MAY PROVIDE ON THE HANDYMAN/HOME-SERVICE WORK ITSELF, WHICH IS GOVERNED BY THE TERMS OF YOUR ESTIMATE OR INVOICE, NOT THIS AGREEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPENDABLE WATER TREATMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE (AS OPPOSED TO THE PHYSICAL WORK PERFORMED AT YOUR PROPERTY, WHICH IS GOVERNED SEPARATELY). OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE ITSELF SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold Dependable Water Treatment harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of this Agreement.

11. Changes to This Agreement

We may update this Agreement from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be noted through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.

12. Governing Law

This Agreement is governed by the laws of the state in which Dependable Water Treatment is located, without regard to conflict-of-law principles.
